1.1 These General Terms and Conditions (hereinafter “GTC”) apply exclusively to all business relationships between the Feelfree Ski School and the course participant (hereinafter “Customer”) in the version valid at the time of the respective booking.

1.2 The subject of the contract is the provision of services, in particular ski instruction as well as guiding and accompanying ski tours (within the meaning of § 1 para. 1 T-SSG 1995), and related activities (hereinafter “Courses”). This also includes any childcare services and associated services (e.g., meals for children).

1.3 Provisions deviating from these GTC are only valid if expressly agreed upon in writing between the Feelfree Ski School and the Customer.

2.1 Course registrations received by Feelfree Ski School—whether made in person, by phone, email, fax, or other means of distance communication—constitute a legally binding offer by the Customer to conclude a contract for the services advertised by Feelfree Ski School. Based on such an offer, Feelfree Ski School will send an order confirmation/booking confirmation to the Customer. Only upon transmission of this confirmation does a contractual relationship between Feelfree Ski School and the Customer come into effect.

2.2 A Customer’s personal declaration to a Feelfree Ski School employee stating the intention to use the school’s services constitutes a legally binding offer to conclude a contract. The contractual relationship between Feelfree Ski School and the Customer comes into effect only upon payment of the selected service and issuance of a payment receipt.

2.3 Feelfree Ski School is not obligated to inform the Customer of a rejected course registration. If the registration is not confirmed within two (2) weeks from the date of receipt, the Customer’s offer shall be deemed not accepted.

2.4 The booking confirmation and/or payment receipt serve as proof of entitlement to use the booked service and must be presented to the course instructor at the start of the course.

2.5 Private lessons are considered bindingly booked—with a claim to course execution—only once full payment for the respective course has been received by Feelfree Ski School.

2.6 Course tickets may only be used on consecutive days. Course extensions at the listed additional fee are possible only immediately following an attended course, upon presentation of the course ticket and with the signature of the snowsports instructor or course coordinator.

2.7 Course tickets are non-transferable and non-refundable. Missed course days will not be reimbursed unless Feelfree Ski School is at fault.

3.1 The Customer is entitled to withdraw from the contract under the following conditions by submitting a written declaration (email is sufficient). In this case, the Customer must pay a one-time processing fee of EUR 30 per booking, but incurs no further obligations—particularly no additional payments beyond this fee and no cancellation charge.

3.2 For booked group courses and private lessons, withdrawal is permitted up to 7 days before the first day of the service/course, subject to payment of the processing fee and without further obligations for the Customer.

3.3 For withdrawals made between 7 and 3 days before the agreed course start, a cancellation fee of 50% of the agreed booking value becomes payable to Feelfree Ski School.

3.4 For withdrawals made from 2 days before the course start, the full amount of the booked service will be charged.

3.5 Timeliness is determined by the date and time at which the withdrawal notice is received by Feelfree Ski School. To satisfy the deadline, the notice must reach Feelfree Ski School no later than 23:59 before the deadline expires. Transmission errors or similar issues are the Customer’s responsibility.

3.6 In the case of group or private courses, the Customer may withdraw for the period starting from the occurrence of an impediment in the event of illness, injury, or accident before or during the course that makes participation impossible. The Customer must submit a medical certificate (without diagnosis) to Feelfree Ski School within 3 days. If the Customer is injured during the course, the certificate must be issued by a physician practicing at the holiday location or the treating hospital.

3.7 In all other cases, the Customer is not entitled to withdraw without the express written consent of Feelfree Ski School and must pay the full course fee. This applies particularly in cases of no-show or late arrival to the agreed appointment, unless Feelfree Ski School is at fault.

3.8 Feelfree Ski School reserves the right to withdraw from the contract at any time if the Customer participates in a course under the influence of alcohol, drugs, or medication to such an extent that safety can no longer be guaranteed. The same applies if the Customer persistently disregards instructions given by Feelfree Ski School, the instructors, or supervisory staff (see section 8.5). In such cases, the Customer has no right to reimbursement of the course fee and must pay the full amount if not already settled before the start of the course.

3.9 Feelfree Ski School will, at the Customer’s choice, issue a credit note for the refundable amount or reimburse the proportional payment to a bank account provided by the Customer within 21 days.

3.10 In the event of a (possibly partial) refund of the paid fee—regardless of the reason—Feelfree Ski School must use the same payment method used by the Customer for the original transaction. A different payment method may be used only if explicitly agreed upon with the Customer and if the Customer incurs no additional costs.

4.1 If the provision of services is not possible for safety reasons (e.g., weather conditions, avalanche risk, etc.), Feelfree Ski School is not obliged to perform the service. The assessment of whether service provision is impossible lies solely at the discretion of Feelfree Ski School. Partial impossibility—for example, if ski lessons cannot be held on three out of five days—does not affect the delivery of the remaining possible service portion.

4.2 In cases of partial or complete impossibility of performance pursuant to section 4.1, Feelfree Ski School will reimburse the proportional fee to the Customer within 21 days.

4.3 Force majeure, including but not limited to epidemics, pandemics, official orders such as lift closures in the ski area, and other unforeseeable and unavoidable events, releases Feelfree Ski School from its service obligations.

4.4 In cases of partial or complete impossibility of performance pursuant to section 4.3, Feelfree Ski School will either issue a credit note or reimburse the proportional fee within 21 days—the choice is up to the Customer.

Any statutory right of withdrawal under § 10 para. 2 of the Package Travel Act remains unaffected.

5.1 All information—particularly price lists of Feelfree Ski School published online, in brochures, advertisements, or other media—is non-binding. Feelfree Ski School reserves the right to make changes at any time. The prices stated in the booking confirmation are binding for Feelfree Ski School.

5.2 All prices listed are stated in EURO (€) and include applicable statutory VAT unless otherwise indicated.

5.3 The course fee becomes due upon conclusion of the contract. For online bookings, payment can only be made by credit card (Mastercard or Visa). On-site payment at the Feelfree Ski School office is also possible in cash. All fees—particularly bank charges—related to payment of the booked course must be borne solely by the Customer. The Customer may only offset claims that have been legally established by a court or expressly acknowledged by Feelfree Ski School.

5.4 Payment default occurs without any further notification by Feelfree Ski School.

If the Customer is in default, Feelfree Ski School is entitled to charge statutory default interest as well as all additional incurred costs and expenses, in particular collection or legal fees. In the event of outstanding claims, Feelfree Ski School may allocate payments made by the Customer to any outstanding debts at its discretion, regardless of any designation by the Customer. If a single invoice is not paid, all other outstanding claims become immediately due.

5.5 If Feelfree Ski School withdraws from the contract for a private course pursuant to section 3.8, the course must be stopped or cancelled immediately. The Customer must reimburse Feelfree Ski School for all expenses incurred in this context and pay the full course amount.

5.6 If Feelfree Ski School withdraws from the contract in the case of a group course, the ski course continues as planned for the remaining participants who are not affected by the withdrawal.

Feelfree Ski School assumes no liability for the participant from the moment the withdrawal is declared.

5.7 The place of performance for all obligations of both Feelfree Ski School and the Customer is A-6433 Oetz / Tyrol / Austria.

6.1 The Customer must arrive on time at the designated meeting point of Feelfree Ski School—or another location communicated by the ski school within the ski area—before the course begins.

6.2 Feelfree Ski School reserves the right to change the meeting point at short notice. In such cases, Customers will be informed by Feelfree Ski School.

6.3 For booked group courses, Feelfree Ski School reserves the right to merge groups before or during the course if the minimum number of participants (4 people) is not met. If a merger is not possible for organizational reasons, the booked and paid course may be canceled. Any refund will be recalculated based on the services actually provided up to that point.

6.4 Feelfree Ski School commits to employing instructors and childcare staff who are qualified in accordance with the Tyrolean Ski School Act (T-SSG).

6.5 Feelfree Ski School does not guarantee training success in connection with the offered courses.

6.6 Feelfree Ski School reserves the right to replace assigned instructors or childcare staff with other qualified personnel—before or during the course—without the Customer’s consent, for organizational or other reasons.

6.7 Group and private courses generally take place in all weather conditions. Whether a course needs to be canceled due to special weather circumstances is entirely at the discretion of Feelfree Ski School.

7.1 Feelfree Ski School is not liable for damages occurring before or during the course unless such damages are caused by intentional or grossly negligent conduct by Feelfree Ski School or persons attributable to it.

7.2 Feelfree Ski School assumes no liability for damages that the Customer causes to themselves or to third parties—or that third parties cause to the Customer—during the provision of the agreed service, unless Feelfree Ski School is at fault.

Customers are advised to obtain personal accident and liability insurance, which remains their own responsibility.

7.3 Regardless of culpability, Feelfree Ski School is not liable for lost profits, purely financial losses, or consequential damages.

7.4 The Customer is advised that not wearing a helmet may constitute contributory negligence in the event of injury. It is therefore recommended that the Customer wear a helmet during courses and use any additional safety equipment appropriate for the booked activity (e.g., an avalanche transceiver when skiing off-piste). Helmets and safety equipment generally reduce the risk of injury.

7.5 It is expressly noted that snow sports involve inherent risks, and that ski touring or off-piste skiing in particular carries an increased risk of injury or even death—especially due to avalanches—which cannot be completely eliminated.

7.6 The Customer acknowledges that rescue operations, whether from pistes or off-piste terrain, can be associated with significant costs. Customers are therefore encouraged to obtain appropriate insurance coverage, as Feelfree Ski School does not cover rescue or helicopter evacuation costs unless such costs were caused by intentional or grossly negligent conduct by Feelfree Ski School or persons attributable to it.

8.1 Before the start of the course, the Customer must truthfully and fully inform Feelfree Ski School about their skiing skills and experience, and independently ensure that their equipment corresponds to current ski technology standards and the prevailing conditions.

8.2 Before the start of the course, the Customer must inform Feelfree Ski School of any health issues that could impair their physical performance.

8.3 The Customer agrees not to participate in the ski course in the case of febrile infections, contagious illnesses, or conditions that involve diarrhea or vomiting. In particular, if symptoms of COVID-19 occur (fever, dry cough, fatigue, breathing difficulties, etc.), the Customer commits to refraining from participating. If the Customer has booked a group or private course, they may exercise the withdrawal right under section 3.4 of these GTC upon presentation of a medical certificate.

8.4 Before the start of the course, the Customer must independently arrange for their ski equipment (especially binding settings) to be checked by a professional service provider. Feelfree Ski School does not perform equipment checks and assumes no liability for this.

8.5 The Customer must follow all instructions issued by Feelfree Ski School or its staff. Failure to comply with instructions or warnings entitles Feelfree Ski School to immediately withdraw from the contract. This also applies if the Customer displays improper behavior, particularly towards other participants.

8.6 The Customer is responsible for arriving punctually at the agreed meeting point. The Customer bears full responsibility for missed courses or parts of courses resulting from late arrival. Feelfree Ski School is not obliged to refund any already paid course fees in such cases.

8.7 Lift passes and sports equipment are not included in the course fee.

Feelfree Ski School is committed to comprehensive data protection and processes the Customer’s personal data lawfully and responsibly. Detailed information on how personal data is used can be found in the Privacy Policy on our website. Upon request, Feelfree Ski School will also provide this information in printed form.

10.1 It is expressly stated that ski tickets or lift passes for the respective ski area must be purchased by the Customer at their own expense.

10.2 No verbal side agreements to these GTC exist. Any side agreements of any kind, as well as amendments or supplements, must be made in writing to be valid. This requirement also applies to any waiver of the written form.

10.3 For all disputes arising from legal transactions based on these GTC, Austrian substantive law shall apply, excluding Austrian private international law.

10.4 Should one or more provisions of these GTC be invalid, Feelfree Ski School and the Customer explicitly agree that such legally effective provisions shall be deemed to apply as come closest to the economic purpose of the invalid provision. The validity of the remaining provisions remains unaffected.

10.5 All rights and obligations arising from these GTC shall transfer to any legal successors of Feelfree Ski School.
